Icasa: SABC could see licence revoked for non-compliance

The SABC could see its licence revoked if it fails to comply with Icasa’s ruling on the broadcaster’s decision not to show violent protest footage.

Acting Chairperson of the Independent Communications Authority of South Africa Rubben Mohlaloga revealed this information when he spoke to 702’s John Robbie this morning to address the SABC’s reaction to the ruling yesterday.

“Our decision is binding to all parties involved in this complaint,” Mohlaloga told Robbie. “Only a court of law can set it aside. If any of the parties are dissatisfied they can approach the courts to set it aside, but otherwise it’s binding.”

“We’ve got authority over our licensees,” Mohlaloga said. “We grant licences and we derive our authority for the prevailing legal framework.”

Robbie asked Mohlaloga about what would happen if the SABC took the matter to the Constitutional Court and lost.

“They’ve got to comply with the decision that’s been made,” said Mohlaloga. “If they don’t comply… [we] can consider what penalties we can impose.”

“We can only impose penalties that the law allows us to impose,” he said. “These would range from giving a caution, depending on the merit of the case, it would be a fine. In extreme cases a license could be suspended or revoked.”

SABC COO Hlaudi Mostoeneng was adamant yesterday that the broadcaster wouldn’t back down on its editorial policy to not show violent protest footage.

“We as SABC are not going to be influenced by people outside or internally. We will deal with the issues of the SABC as per the processes in the organisation,” Motsoeneng said.
