Apple could pay up to $500 million to resolve iPhone throttling case

Apple could be forced to pay up to $500 million as part of a class action settlement in the US.

The class action comes after Apple deliberately slowed the performance of older iPhones. While Apple did this to mitigate stress on the batteries of older devices it didn’t tell users about this.

The incident was dubbed Batterygate and Apple was forced to drop the price of battery replacements.

The settlement covers current and former US owners of iPhone 6, 6s, 6s Plus, 7, 7 Plus and SE devices running iOS 10.2.1, iOS 11.2 or later and those who ran those iOS versions before 21st December 2017.

The minimum amount Apple has agreed to pay is $310 million but that figure could go as high as $500 million.

While that is a tidy sum, class action members will only get $25 per iPhone owned. That amount could increase, or decrease, depending on the number of approved claims.

Named plantiffs (which can be found here) are also seeking service awards ranging from $1 500 to $3 500 according to Bloomberg Law.

The class settlement is awaiting final court approval and has reportedly taken months to negotiate.

Between December 2017 and June 2018, 66 proposed class suits against Apple were filed. Bloomberg reports that the U.S. Judicial Panel on Multidistrict Litigation combined the suits in the U.S. District Court for the Northern District of California in April 2018.
