High court upholds ruling on SABC COO’s “irrational appointment”

The Western Cape High Court has dismissed an application for leave to appeal against a ruling that SABC COO Hlaudi Motsoeneng’s appointment was irrational.

This is after Mostoeneng and Minister of Communications, Faith Muthambi, had applied in November last year to appeal the court’s previous ruling that the appointment was unlawful.

The ruling came about after the DA had sought a court order in the previous month. Effectively, this new outcome means the original ruling stands.

Motsoeneng and Muthambi were both in attendance when Judge Dennis Davis made the ruling.

Davis mentioned that it is concerning how much government litigates, given “lavish” costs, especially in cases with little merit.

The matter goes back to 2014, when the court ordered Motsoeneng be suspended following a report by Public Protector Thuli Madonsela, which found that, among issues, Motsoeneng had lied about his matric qualifications and irregularly increased his own salary three times in a single year.

This is the second application for leave to appeal over the matter by Motsoeneng that has failed.
