Mudge subpoenaed by Musk to lay bare the Twitter bot problem

The battle to uncover the truth behind Twitter’s bot problem continues for Elon Musk and his legal team. Ahead of a trial in October, Musk has now subpoenaed Peiter “Mudge” Zatko.

Last week Mudge, who is also the former head of security at Twitter, detailed claims of ineffective security, a lack of accountability on the part of executives and a more pervasive bot problem than the company says it has.

Twitter chief executive Parag Agrawal claimed that Mudge was pushing a “false narrative that is riddled with inconsistencies and inaccuracies, and presented without important context.” However, Mudge has a reputation for being one of the most ethical people in the cybersecurity space.

At the time Musk’s legal team said they would subpoena Mudge and that request was filed this week according to a report from The Verge.

In addition to deposing Mudge, Musk’s legal team has requested a tome of documents. These include documents relating to Twitter’s monetisable daily active users (mDAUs), documents relating to the audit of spam on the platform and many others dating back to 1st January 2019.

While Mudge’s claims and Musk’s reasons for backing out of the deal align in certain aspects, we have to wonder whether it’s enough.

Back in July during a hearing, The Wall Street Journal reported Twitter’s lawyers argued that the merger agreement Musk signed didn’t make any promises about the amount of fake or spam accounts. However, Musk’s lawyers could argue that Twitter lied in order to lure Musk into a purchase.

The point remains however, that Musk and his legal team waived their right to do due diligence before signing a binding agreement to pay $54.20 per share for a meme.

The trial between Musk and Twitter begins on 17th October.
